Legal Question in Real Estate Law in Oklahoma

amendment to a deed

I have a property, that 30 odd years ago a woman made an amendment to it giving it to her husband after their divorce. In the tax office records it shows that my husband and I own it. The bank is saying this is not leagal, and that she owns one half of the property. Is this so?

Re: amendment to a deed

Thank you for your question. However you have not presented enough facts from which I can make an informed opinion as to what transpired 30 years ago, the type of amendment you are talking about, or how it was that you and your husband obtained title. A quiet title suit might be brought to help clear up the matter. However, an attorney is going to need to review all of the documents in the record of title to figure out what rights you have versus the rights of someone else. Quiet title suits run from $750--1500 plus court costs depeding on the facts.
