landlord responsibility for personal injury of tenant by electrical shock

What are the responsibilities of a landlord for personal injury to a tenant from the following: tenant experienced a electrical shock by touching a wall. not a outlet, just a wall with her hand. shock occured while tenant was at residence cleaning to prepare to move in. residence was in filthy conditions. tenant was preparing to clean when she merely touched a wall and was shocked...tenant has a 3 year old child and was unable to move into residence due to the electrical danger..tenant then had to stay with a friend for 1 month until could locate another residence.landlord now refuses to return any deposits.i would like to sue for personal injury, pain and suffering(for electrical shock, dislocation of family with no place to live for 1 month)and return of rent and deposits.what can i do?

Thank you for your question. Your personal injury claim sounds like it may be difficult to win. Has anyone told you how you could receive an electrical shock from touching a normal (gypsum board) wall. I am not saying that you could not receive a shock. Perhaps the wall was other than gypsum board. An attorney would need to know how you were shocked in order to develop a theory of liability on the landlord. Second, did you have medical treatment. If not then you would have difficulty obtaining a judgment without treatment for a bodily injury. Assuming you can prove a mechanism causing the electrical shock, you should be able to sue for collection of your deposits back and I would think for any additional costs of housing your family until another place was found. The landlord has a duty to deliver a habitable place to you on the date your lease was suppose to commence. From what you have said he delivered an uninhabitable place.
