Legal Question in Real Estate Law in Oklahoma
Lease and raising rent
My daughter has a 12 mth lease on a 1 br apartment in Ok. It isn't up until 2/2001 and is for $345. They recently posted a notice stating rent was going up to $390 for 12 mth leases and $420 for 6 mths starting 9/2000. They commented that "if you already were under contract..do nothing except come by and sign a new lease." Don't they have to honor the old lease and old rent until its up? Can they break the old lease just to raise the rent? If they can, and she decides to move (she can't afford $390), don't they have to give her back her deposit, etc? They you.

Re: Lease and raising rent
Assuming your daughter's lease doesn't contain a provision allowing the landlord to raise the rent, then she doesn't have to sign the new lease. A landlord must honor its contractual obligations just like your daughter must.
