Legal Question in Real Estate Law in Oklahoma

Liability to property damage

If you damage someone's building, are you required to pay for improvements or additions to bldg? Ie, prior to accident the bldg had no windows, after the accident windows were placed on bldg. & they want us to pay for them?

Also, are there any limits to paying salaries for clean-up?

Re: Liability to property damage

Thanks for your question. As a general rule you are liable for the reasonable costs of repair to place the property back into as near condition as it was before. Therefore improvements, upgrades, etc would not be your responsibilty. Wages or salaries should be reasonable with reasonable being what the going rate for that type of work in your community. Other damages may apply such as lost rent or other costs directly flowing from the injury to the property.
