second mtg loan

my husband signed a second mtg loan without my ok, is this a legal binding contract in okla. he borrowed the money for a business that has failed would bankruptcy eliminate this loan

This is a fairly complicated area of the law and a number of exceptions apply. I would need to examine all of the relevant documents and obtain all of the facts on the transaction to be able to advise you specifically. Generally speaking however, if the property used to secure the loan is your homestead and you did not sign the mortgage, then the mortgage is void.
