Legal Question in Real Estate Law in Oklahoma

Notification of Covenants

When having a home built, is there any requirement that the party having the home built by one of three builders building in the subdivision be advised of existing covenants? After building a shed on the property we were advised that we had violated covenants we were not told existed. Do we have any grounds to not have to have the shed removed, and then possibly rebuilt after receiving the apporval of a ACC?

Re: Notification of Covenants

Thank you for your question. Covenants and restriction run with the land if they have been filed of record. Thus giving all who purchase property therein notice of same. The abstract for your property should have contained copies normally in what is referred to as a Deed of Dedication. If the covenants and restrictions are not filed of record, then I would question whether you are obligated to abide by same. Please visit and Bookmark my website: www.urgentlegalcare.com
