Renting a house

We have lived in the same house for 4 yrs, always paid rent on time. My landlord sends me a 30 day notice to move, notice is dated 10-1-04, i recived it 10-12-04. do i have 30 days from 10-1-04, or 30 days from 10-12-04. The letter she sent me was not a legal doc.Also was sent to me in mail from ND.

Assuming that you are on a month-to-month lease or that your long term lease has expired resulting in a month-to-month tenancy, you are only entitled to a 30 day notice to quit. In my opinion you have not received the 30 day notice which you are entitled to as the notice indicates that your 30 days would expire at the end of this month. I would write a letter back to the landlord, keeping a copy, and sending it certified but without requiring that the landlord sign for receipt. The letter should state the date that you received your notice and that you will move within 30 days of that date. There is little the landlord can do at the end of the month except to try to evict you through court eviction which will take about two weeks at which time you will have moved out.
