Legal Question in Real Estate Law in Oklahoma
The teenager next door ran her dad's truck through our fence. The dad wanted to avoid us putting a claim against his car insurance, and said he wanted to "do the work himself." He was going to simply replace the old panels with new ones, which would not match. I asked for an estimate from my homeowner's insurance company. Their estimate was $1600. My husband says it's too much. I gave the neighbor our estimate with a note that says he needs to tell us whether he wishes us to file with his car insurance. He's never even given us a policy number. Meanwhile, our backyard has been open by four missing panels, not to mention our backyard belongings exposed, and we have to watch our dog when we let him outside so he won't run out in the street. What's your take?

This is my response:
Please obtain an estimate of repair from 2 sources. Then serve the estimate on the neigbour. Give him 7 - 10 days to respond. If not file a small claims suit and collect the money. The claim is against his homeowners' insurance rather than the vehicle insurance. Regardless, he owes you money.
