Legal Question in Real Estate Law in Oklahoma
For the last two years I have been renting a home from a real estate leasing company on behalf of a homeowner. Our realtor just got us to sign an extension for anther year's lease. Just found out that the homeowner stopped paying the mortgage almost two years ago and the bank has foreclosed on the home and sold the mortgage to another bank for collection. No one including my realtor can get in contact with the homeowner. This bank served us papers for saying since the homeowner was not able to be contacted and we were residing the the premises, that they want to collect on the mortgage from us. What legal recourse do I have? I can document rent payments to the leasing company of more than the cost of the mortgage for the last two years. Does my realtor have to find me another place to live as we're under lease for another year? Do I need to get an attorney? The summons lists occupants of premises, but not my fiancee or myself by name.
