Legal Question in Tax Law in Oklahoma

statute of limitition

My wife received a state tax bill in 1994 for the tax year 1991/1992. We made payments on it,then for the last $500 we paid it off. In june 2005 we got a call from a collection agency about the same bill. I called the OK tax commission, they told me it's still outstanding. After all these years we distroyed all records older than seven years, even the IRS requires you to keep records for only 7 years back, and here we are 14 years later they are asking me for receipts I no longer have. I know I paid this tax off. Is there a statute of limitation on this. If I'm required to pay this bill again it will be double taxation. Please help me. Thank you.

Re: statute of limitition

The Statute of Limitations period for collection of OK taxes is ten years from the date the tax was assessed. Unless you agreed to extend the time, collection activity should be barred.

The way you'd want to handle this with the collection agency is to write them a certified letter informing them that: 1. you have fully paid the debt, years ago; 2. the Statute of Limitations has run on this debt, so even if you had not fully paid it, they have no legal right to attempt to collect it.
