Expired Safety Inspection

Small town just called my brother says he hadn't paid ticket on expired safety inspection sticker from 18 yrs ago. Does he have to pay the ticket now plus hundreds of dollars in late fee? OKLA no longer has safety inspections on vehicles. And he has not relocated or anything in all this time. He has been pulled over and had other tickets during this time. If there was a warrant, wouldn't he have found about it at other traffic stops? Is there a statue of limitations or anything on this type of violation?

The fact that Oklahoma no longer has inspections stickers is irrelevant to this case. Statute of limitations have nothing to do with this case. Statute of limitations have to do with the time period the government has to charge a defendant with the crime after the crime has been committed.

There is some case law in Oklahoma that says the state must use due diligence in executing warrants or otherwise brining a defendant before a court. You might prevail on that argument in this case. However, the cost to hire an attorney to file the motion and go to court to argue the motion will probably cost as much as, if not more, than the fine.
