Your course of action depends on whether the property is real or personal. If it personal such as a certificate of deposit, or the proceeds of a bank account, the bank or investment company will tell you what documents it will need, besides a death certificate.

If your interest is in a real property, such as land or house, then the answer depends on whether you are a co-tenant (equal shares) or a joint tenant with right of survivorship. If you are co-tenant, then you must seek probate. If the property was held in joint tenancy with right of survivorship, then you must file at the office of the county clerk, an affidavit terminating joint tenancy.
