who gets deceased mothers estate?

my fiance's mother will have died 3 years ago this March. We can't find a will. Her house and car were paid for and they have been sitting all this time. Her mother is divorced and the house nor the car were ever signed over to anyone else. The property taxes have been paid every year and we have paid to have the lawn care kept up. There are 3 children of the mother that are all over 18yrs old. What is the process to sell the house and does it just get divided among the 3 children? My fiance has been paying the bills for all this time, does she get any allowance for that? They were waiting 3 years because initially a lawyer told them that if they didn't wait 3 years than the hospital could take the money from the house for money owed on bills...is this true? We just need some direction. Thanks

Her estate will need to go through probate so that clear title can be conveyed to the heirs or a buyer. The vehicle can be sold or distributed to the heirs through probate as well. If your fiancee has records of expenses paid to preserve assets of the estate, then the court should allow reimbursement.
