Legal Question in Wills and Trusts in Oklahoma

When my father died, my stepmother did not have the money for cremation, memorial service so I paid for it all. She said she would pay me back. She died 6 months later. She also said she would deed me my fathers house when she died. She didn't do any of what she promised. What are my chances of getting the money back for the funeral? Nothing was written on paper. It was just verbal promises. What about my father's house ? She left it to her cousin.

Was the house in joint tenancy with your father and step mother?

If it was, the court will not give you any relief as to the house.

Did your father leave a Will as to the remaining assets? If he did, you need to find a copy and see what it says. If step mother probated the Will, it would be at the local courthouse.

If your dad did not leave a Will, you could seek probate to recover your costs and expense. You will still have to bear the expense of probate.

I will also refer you to tit. 84 Okla.Stat. Section 213 for intestate distribution (when there is no Will).
