Legal Question in Wills and Trusts in Oklahoma

My mother recently passed away in Tulsa, while I live a thousand miles away in Florida. A local relative said they were going to handle getting probate started, but it's been a few weeks and I still haven't heard anything. I'm attempting to contact them but they don't seem to be responding. What should my next steps be?

1. Ask yourself: why are you filing probate? Are there probate assets in Tulsa County? Did she leave a Will or a Trust to cover any of her probate assets?

2. Second, look at the probate docket through OSCN.NET for Tulsa county to find out if any proceeding was filed in your mother's name. Do a search using your mother's full name. If anything was filed in Tulsa county, it will show up.

3. The best thing to do is to contact a lawyer to initate probate. It is never a good idea to ask well meaning relatives to do a probate.
