I father left me his home & property that was in his name only, but there was a joint tenancy/ surviving spouse deed. Does the home and property now belong 100% to my step-mom?

First off, please accept my condolences on your loss.

You need to clarify where your father was domiciled when he passed away, as the laws of the state where he was will determine where the probate will be filed.

If this happened in WA, your step mom would take the community and one half of his separate property and his children would take the other half of the separate property by operation of law if there was no will.

If there was a valid will, WA would uphold your father's intent regarding distribution of his estate.

But you will need to check with an OK lawyer re their statutes; I'm not licensed there.
