Legal Question in Wills and Trusts in Oklahoma
Rights of Sons
My sister died a year ago. Her husband has remarried. He is not supporting the 18 year old adopted son who is still in high school. He has refused to help with room, board, car insurance, health insurance, and other necessities. My sister left a comfortable sum of money through life insurance policies and accident insurance. The house and vehicles were paid in full because of credit life insurance. Do the 18 year old and his adult siblings have any legal rights to the assets their mother left?

Re: Rights of Sons
If the Mother left a will leaving everything to her husband then no, the children have no claim to her estate. If she died without a will, then the children have a claim to 50% of their Mother's estate under the laws of intestate succession.
Child support obligations ordinarily terminate when the child reaches the age of majority. There may be exceptions for special needs children.
