Legal Question in Wills and Trusts in Oklahoma
Three siblings say Dad was taken advantage of during his last days by the younge
10-77 Will made by dad and mom (oldest executor)
2-94 Trust (oldest executor)
3-85 Mom passes away
7-98 Dad has stroke ( Sister takes all checkbooks and cd certificates home. Sister refused to return them. Sister said I can be trusted.
11-98 Sister has doctor revoke Dad's license. Sister says Dad gets lost and disoriented.
11-98 Dad makes new will
2-99 Dad buys new 1999 Silverado (Sister says it is mine) (Dad says it was his) (Unsure how to find out true owner or when it was signed over to sister.)
3-2001 $40,000.00 CD cashed (Sister says it was a gift.) 4-4-00 Dad revokes trust and POA
7-00 Dad passes away.
10-01 Dad's utilities are still on. Sister says ''I have food in the freezer.''
Three siblings have one question each:
1.Due to the length of time passed how do I obtain a copy of the letter, Dad received in November 1998 from the Department of Public Safety? (This would prove Dad was not in his right mind to make out a will)
2.Is the Sister who is the executor responsible for informing siblings any information about the estate or how the funds were spent and deposited?

Thank you for your questions. If a letter from DPS or copy exists you can subpeona it. I do not know what their policy is for providing a copy to someone who requests it otherwise. Concerning question number 2, I assume that a probate has been opened and if so the executor has a duty to file an inventory, handle the estates business and make reports to the court and render a final accounting when the estate is closed.
