Legal Question in Workers Comp in Oklahoma
worker's comp law
my husband tore his ACL on the job in March, he had surgery in April and 2 days later he had to be taken back to the hospital, he was in a coma for about 10 days, the initial diagnosis was aspiration pneumonia, however the doctors found that he had suffered from low oxygen level and that he did have some brain damage. He was on a ventilator for 2 weeks and had to have a tracheostomy. He spent 7 weeks in 3 different medical facilities and has continued with physical and speech therapy since he returned home. Worker's comp has assumed responsibility for all of the medical costs due to the fact that the second hospitilization occured less than 48 hours after the surgery for the ACL so they feel like there is a connection between the surgery and the second hospitalization. W/C has continued to pay both mileage and weekly benefits. My husband may be released to return to work soon because he has recovered well. My question is do we need to contact an attorney before he returns to work? Will my husband be offered a settlement at the end of his workers comp case?
