Legal Question in Bankruptcy in Oregon
Credit Beareau report
My husband and I filed Bankruptcy in 2000, We chose to keep our home, and have been making payments since Bankruptcy. The Mortgage company has failed to report our payments for all this time. We want to re-finance, however, without a mortgage history, we are having difficulty proving we have a mortgage. They state, because of Bankruptcy, they don't report our activity. They say we are no longer responsible for the loan, but wiil accept volunteer payments. We have livd in our home 33 years, and all we are trying to do is re-finace at a more affordable rate. They are preventing us from this.

Re: Credit Beareau report
You have the original loan documents of the exisiting mortgage and/or the mortage statement up to the time you filed your bankruptcy. You have the cancelled checks or you can obtain them from your bank and you have your bank statements demonstrating a continous timely paymentsince the bankruptcy. Present that to the new lender and see what they do.
