Legal Question in Business Law in Oregon

No breaks, Long shifts

I work for the local Mcdonalds, i am constantly scheduled 5 1/2 to 5 and 45 min just to keep me from getting a lunch break. This in itself is not the problem. Not only are they being cheap by doing this, on several occasions, i work a 5 1/2 to even a 6 hr shift and do not receive one break. Is there anything i can do legally? Can i sue them?

Re: No breaks, Long shifts

The 30 minute unpaid, uninterrupted meal break applies to shifts of six hours or longer. The employer is probably in compliance, and it is common for employers to make scheduling decisions to avoid providing benefits such as breaks, overtime, entitlement to nonmonentary compensation, etc.

A paid 10 minute rest break must also be provided for each four hours you work.

If your manager will simply not comply with your request for a 10 minute breaks, bring this to your company's HR department and request that they contact your manager to correct the situation.

Good luck with your long hours!
