Providing a party at place of business and liability of owner

My uncle owns a business and has a warehouse. We were goins to provide a concert, and alcohol will be present. How do we take away any liability to him and his business in the case of someone getting hurt, or in a wreck on their way home. And what if alcohol is provided to those under age without his acknowledgement? People 18yrs and older would be present.

Typically you cannot eliminate your uncle's liablity, but you can insure him for it and you can set the event up in a manner that manages the risk. You also need to be concerned about your own liability if alcohol is served, especially when there are minors present.

Will this be a private party, or are you charging for admission or the alcohol?

Since this appears to be planned as a large, possibly commercial (admission charging) event, you need to be very careful that you meet Oregon's laws regarding the serving of alcohol. I usually recommend that clients hire professional bartenders for any large event, even if you are not charging for admission or the alcohol because then you have a trained person who knows how to deal with not only the underage drinker, but also the one who has had too much.

If you are charging admission or for the alcohol, you must have a license if you are going to serve alcohol. The requirements for a license usually precludes attendance by those under the age of 21. Obtaining a license for a one-time event can be difficult, but the ramifications of failing to do so are significant.

Obtaining a license can be a time-consuming procedure, and one that should be started well in advance of the event. If your event is planned to occur within the next month, I doubt that you will be able to obtain a license because of the time constraints in the process.
