Can I sue a spouse?

The ''cabinet maker'' i hired installed 1/3 of the ''boxes'' and refused to

continue without receiving the after installation portion of the bid, I refused to

pay until they were completely installed, he threatened to take us to Small

claims court, I called the builders board, found he was unlicensed, they

investigated and fined him $5000, for entering into this contract with me. I

am suing him in small claims court, for the maximum, which is $300 short of

my deposit, I also want to sue his wife, she signed the deposit check and

put it into her bank account, she has their house in her name only, she is

the only one of the two with a bank account or legitimate job Is it legal for

me to include her in the lawsuit even though she didn't sign the contract?
