Legal Question in Business Law in Oregon

University fails to follow Federal guidelines

A private University neglects to follow procedures to help us secure a Parent Plus loan, causing us to scramble to quickly locate another lender before our son is unregistered. Their computer has also erroneously stated the loan was dispersed when in fact it never came in due in part to their failure to send the complete information. Do I have recourse?

Re: University fails to follow Federal guidelines

My feeling is that you probably received disclosures that stated that the loan is not guaranteed until it is funded. I would need a lot more information such as did you miss a deadline due to their delay, and the significance of what they did or did not do. This is one of those things that you try to work as a matter of good business practices... but I am not seeing a good breach of contract action here, and no other cause of action is coming to mind. Perhaps there are some federal lending regulations that would apply and that should be checked assuming you want to spend the time and effort. Good luck.
