Legal Question in Business Law in Oregon
Withdrawing from a general partnership
I am involved as a general partner in a small motorcycle repair shop. Within months after opening we were not making enough money to pay buisness bills so we both decided to get jobs.Long story short, I got a job and have not had anything to do with the buisness for several months. He decided to stay with the buisness and has spent all the money (including a customers deposit of 9000 dollars). Now, he is holding my personal property unless i pay him ''my half'' of the customers deposit. Currently he is operating with no buisness license and no insurance. Basically I need to know what to do now.

Re: Withdrawing from a general partnership
Did you have a written agreement? Did you invest any money? There may be a couple of things to do. You can always sue, but that may take money and time. Try to work it out and come to an understanding of what the agreement was. Also, you may be liable for the lost customer deposits, so you will need a full accounting of everything going on with the shop in your absence. You need to determine whether you are in or out of the business. Then, you can decide on course of action.
