Legal Question in Civil Rights Law in Oregon
is this a civil rights case?
on sept.26th 2006 at approx.12:30-1:00am i was asleep at my boyfriends house in his room down stairs. The portland police K-9 unit and three other officers approached the door of the house.after a while my boy freind let them in.They were looking for a guy who lived there 6 months or more ago.Tony my boyfriend told the cops havent seen him hasnty been here. They said they would keep the dog on his leash if he let them search his house. He let them and so they were so convinced that the one they were after was there they stood at the top of the stairs as they let the dog go and started shouting down the stairs better come out while you still can..All of the sudden i feel the bed move so i turned around to see what shook the bed that much and wham i pretty much handed the dog my arm.He bit me on my right arm 43stitches inside and out 8 punture holes on the both of my feet.Unfortunately at that time i did have a warrent for my arrest, but that is not why they were there to begin with, different county i was taken into custody treated like a piece of shit.So i wonder if i have a case?

It sure SOUNDS as if you may have a case, but I would need to ask you a number of other questions to really answer that. Let me ask a few:
There was no reason for the dog to have been set LOOSE like that, right? Did the police every ASK Tony if anyone ELSE was in the house? I'm guessing that if he were ASKED that question, Tony might told them 'NO,' since you had that outstanding warrant. But, do you know? Can you ask him?
How have you recovered from this dog attack so far? How bad are the scars? What have the doctors told you, in terms of whether you'll need more surgeries, and how many operations?
Oh, and a general question: How old are you? What sort of work do you do, generally?
It's VERY IMPORTANT that you consult with a lawyer IN PERSON on a case this. There may be some important and EARLY DEADLINES to be aware of -- the state Tort Claims Notice law requires you provide a specific type of notice just 180 days after the date of the incident, or you could lose your right ot make a claim later.
MANY lawyers who handle these types of cases are willing to handle this on a 'contingency fee' basis. My own firm might well be interested, too.
BEST OF LUCK to you, and I hope you heal without too much scarring.
