Legal Question in Civil Rights Law in Oregon
legal malpractice law
attorney hired for civil suit involving dissaloution of a business partnership. attorny admittedly dropped the ball,failing to file a motion in the given time period (fiduciary misconduct?) Now 7 days prior to arbitration he wants to refund our retainer minus filing fees. We need an attorney for two matters now. anyone willing to help? Or offer any advice?

This would appear to be malpractice. Every attorney in Oregon is required to carry a minimum of $300,000 in coverage, per incident, for legal malpractice. This insurance is provided by the state bar, so the funds are actually available.
You should probably not accept the refund your attorney is offering, so there can be no implication that you have settled with him.
You need a legal malpractice attorney. You might consult with Kafoury & McDougal in Portland.
