Legal Question in Civil Rights Law in Oregon

My neighbor received tickets for public nuissance and criminal mischief. This angered her, so she call my husbands work and made a lot of false accusations against him trying to get him fired. Can we sue for emotional damage and deffamation?

You can sue for slander (vocal false statement that harms person). But you may have a problem proving an amount of damages, unless your husband's boss took the calls seriously or imposed some sort of harm on your husband as a result of the calls. It also depends on what she is saying on the calls. There are different types of false statements, like the difference between "He mows his lawn in his underwear" v. "He is a criminal." You also may have a problem proving that the slander occurred, unless your husband's boss is willing to testify about the calls (or you are willing to subpoena him to testify about them).
