Legal Question in Construction Law in Oregon
I'm a contractor. We file complain with insurance company of my subcontractor for poor work which led to dry rot. Independent inspection showed that subcontractor is 100% in fault. After 4 month since we file a claim insurance adjuster doesn't want to comply with our demands for compensation. Home owner is angry and want to fix deck ASAP since rain will start in a month.
Will it be good idea to fix deck out of my expense and then file law suit for damages against insurance company, or should I wait longer to get compensation ( and may never get?)

This is more of a business decision than a legal one. If it is a reputable or major insurance company, you will probably get paid eventually. Be sure to file a complaint with the Insurance Division. See http://insurance.oregon.gov/consumer/tomake.html
