Billing practices by garbage hauler.

Can a garbage hauler change it's

practices in assessing overfill charges,

which were never enforced, even if

the their policy was previously listed?

Additionally, it seems dishonest to

change practices in how they assess

fees without providing feedback

before a customer runs up 9 overfill

charges. Are these business

practices legal? Ethical?

It depends on what is allowed by the local regulator, which is usually the city or the county or a sanitary district. You should call the local regulator and ask whether a hauler can retroactively impose overfill charges, when they were not included on the contemporaneous bills. Ordinarly law pertaining to business practices very likely do not apply to regulated haulers, because their practices are governed instead by the specific regulations of the local regulator.
