It is not a clear cut case. If you were the homeowner who hired the contractor, why did you not get a permit for the construction (the inspectors would have come back to inspect the roof before they signed off)? If you bought the house from the owner who made the repair, did your home inspector examine the roof? Did the seller make any representations about the roof?

There are general proof problems (was "not following code" or "manufacturer's specifications" the cause of the damage)? Also can you verify this to actually be the case, meaning - that it truly is not up to code?
