Legal Question in Consumer Law in Oregon
Faulty Furniture
I purchased brand new furniture in Oct 2004 from a large, local and reputable company in Oregon (I live in Washington). I was never informed of their ''No Refund or Return'' policy. I found out about this policy when I first began having quality issues w/ this furniture, 11 days after purchase. I have had numerous problems such as broken wood in the framing, stitching around cushions weak and breaking, broken springs and recently discovered some springs that are rubbing the fabric and making holes. I have documented all of these problems and am tired of calling this company to repair brand new furniture. I have had their customer service department in my home repairing this furniture on three different occasions. I have also had to exchange (replace) a loveseat at my inconvenience by taking it back to their warehouse and picking up the replacement. Is there a way I can get them to issue me a credit, if not a refund? I think the quality of this particular sofa set is the issue. I have purchased from them in the past with no quality issues like this. What can I do?

Re: Faulty Furniture
You have a consumer protection issue. Call your county Bar association (Clark County?) and ask for a referral to an attorney in your area who can help you with this.
Some attys are willing to take on claims like this because they can, if they win, get the other side to pay their fees pursuant to the Consumer Protection Act.
On the other hand, if the value is less than 4K you might think about taking it to small claims. READ RCW 19.86 (the CPA) first, though, and talk to an atty before you do anything further. This is not meant to encourage you to 'do it yourself' just to point you in the right direction. Good luck with your claim!
