Legal Question in Consumer Law in Oregon

I purchased a billy goat (lawn mower) for my property .We took it to the property and the first time we used it - started smoking and leaking oil. I immediately called the person I purchased it from - who I find out went somewhere else and purchased it for me. He acts like I cannot return it even though it is a lemon.

There is no "lemon law" when you buy a used lawn mower from someone.
You can sue the seller for breach of contract, if you can prove that he told you that the mower was in good operating condition. Can you prove that? Then go small claims court. For more info, see http://www.osbar.org/public/pamphlets/smallclaims.html
