Legal Question in Consumer Law in Oregon

I have a van i bought that is covered by a warrenty on the transmission I first dropped it off on 2/22/12 he said it would take a week so i called back in a week took me about 5 times callimg him before i made contact. The shop told me he had to order the part but i could drive it in the mean time.I took the van back on 2/29/12 and they have had the van ever sense. My husband is in a wheelchair and has had to miss doctors apointments. How do i get my van back?

Talk to the owner of the shop. Tell him to give you a date when it will be ready. If date is unreasonable, pay a lawyer to write a letter demanding prompt action. Finally, if none of this works, 1) you can sue in small claims court asking the court to order the shop to perform the service, or 2) take the van somewhere else to fix it and sue in small claims court for what it cost you to fix the transmission. Just be careful if you have it fixed somewhere else because you will have to defend against the argument that the shop should have had more time to fix the problem.
