Legal Question in Consumer Law in Oregon

verbal contract for camper in oregon

Hi - we advertised a camper/toy hauler on craigslist and had a person come out and offer us full price - said he would bring us the money the next day - we agreed. Later that night we had a guy call us (for sale sign on trailer) from outside our house wanting to look at the trailer - he offered us $1000 more than our asking price i he could take it right then - we sold it and called the other guy and told him it was sold - he freaked out and threatend to sue us for verbal contract - but we did not exchange money or any written agreement - can he sue us?

Yes, he can sue you. But can he win anything?

First, he has to prove that you agreed to the sale at a specific price at a specific time. What proof does he have of this? Is it his word against yours?

Second, what does he win, if he wins in court? He has to prove that your breach of the oral contract has caused him "damages," meaning monetary harm. What is the harm to him of not buying your trailer? He would have to show that he went out and bought a similar trailer for a higher price.

So, it is very likely he will not sue you, anyway.
