How can someone obtain your bank account info eg; creditor, and have your money held ? Doesn't this have to go through the courts first ?

Yes creditors can find out if you have bank accounts... you need to negotiate payment plans with them if you don't want them to garnish your wages.
Yes, it has to go through the courts first. The creditor probably got a default judgment against you already.
