Legal Question in Criminal Law in Oregon
d.a. now judge
If the district attorney that sent me to prison on a seperate case is now a judge in a new case against me can they legally preside over my case or is it a conflict of interest?

You can file a motion and affidavit to disqualify the judge if you think he'll be unfair and prejudiced against you but you have to do it very soon after you hear that the judge has been assigned to your case. The time limits vary depending upon the population of the judicial district. ORS 14.270 et seq.; State ex rel Kafoury v. Jones.
