expungment

i was recently indighted for felon in posetion of a fire arm for a crime i commited in 1985. case this new case is in washington the conviction was in oregon upon finding out that i was a convicted felon i started the process of expunging the 22 year old conviction. while in the midle of this process i was indighted for the obove crime. my atourney has got the D.A. to reduce the charge to a misdamenor. but for expungment purposes it states that i not be under charge of commision of any crime. my question is if i am convicted of a misdamenor wil i stil be able to have this expunged from my record?

You will be able to vacate the felony but you'll have to vacate the misdemeanor first. So, this will delay things. Depending on the final charge, you'll have to wait 3-5 years from the completion of probation on the misdemeanor to have it removed. Good luck with your case.
