Legal Question in Criminal Law in Oregon
negligence??
My sister was recently incarcerated after a DUII vehicle accident. While she was in jail, she repeatedly asked for medical assistance for injuries sustained in the accident. My mother also repeatedly contacted the jail to inform them that she needed attention. When the staff nurse finally did examine her, she said that she was fine, and all she needed was aspirin a couple times a day. Upon release, she went to her regular doctor, who examined her and found that she had sustained a cracked sternum, cracked ribs, dislocated collarbone & broken nose in the accident, but could do nothing about it because it should have been taken care of right after it happened. What I (& she) are wondering is would this be a case worth pursuing (such as negligence or misconduct or something), and if so, how to go about getting it going.
