Legal Question in Criminal Law in Oregon

Prosecution of Canadian citizens in the US for crimes committed in the US

I am wondering what the procedure is for prosecuting a Canadian citizen living in the United States (Oregon) for a crime or crimes committed while living in the United States (assuming the perpetrator is apprehended in the United States).

Is prosecution under Federal or state law possible, is the perpetrator deported (assuming sufficient cause is presented) and turned over to the Canadian (or provincial) legal system, or is the action taken based upon the circumstances of the charges brought?

Thank you so much for any information you can provide on this matter. My wife and I are in the very early stages of an investigation involving the sexual abuse of our daughter by a Canadian male married to my wife's mother in late 2002.

Thank you again.

The procedure for prosecution of an alien is the same as that for a U.S. citizen for most criminal violations.
