Legal Question in DUI Law in Oregon

Penalties for going out of your area

I have a friend who is on probation for DUII. He has a blowing device attached to his car. He has completed all his requirements of his probation but still has a restricted license to drive only to work and back (I think for 7 more months) and has to drive the car with the blowing device on it. He was pulled over yesterday and was out of his line of travel and also was driving his other car with the device on it. He had not been drinking and hasn't since the offense 5 months ago, he told the officer he was stopping by his girlfriends and then was headed home. they towed his car, and do you know what else he could face. How serious is that? Thanks for any info you can give me.

Re: Penalties for going out of your area

Your question is missing some information, but I will try to answer it the best I can.

If you friend is in violation of his probation then the penalty can by up to 1 year in jail, minus anytime they already served on the case. If the case was a felony DUI, then he could be looking at postprison sanctions as well.

Other possible penalties include loss of driving privledges. The DMV will be notified and may revoke the hardship agreement.
