On 2-27-06 my wife filed for divorce. I was served. Only condition was that she receive 50% of my monthly retirement payment. There were wittneses to her request for only 50%. Upon reaching my retirement qualification, instead of my payment. I received notice that she had filed a "qualified domestic relations order" without informing me, demanding 100% of my benifits. We were married over 20yrs. How can I recover my 50%?

In order for you to recover your 50%, it will be necessary to employ the services of an experienced family law lawyer who is also knowledgeable about QDROs and their use in dividing pension and retirement interests incident to dissolution of marriage. The lawyer would have to obtain (or be provided with) a complete copy of the case record from the divorce court (including the divorce decree and the QDRO) and would then be able to determine exactly what happened and what now needs to be done.
