Legal Question in Family Law in Oregon

Abandonment and Debts

If a husband abandons his wife and children, moves to Las Vegas and gets a credit card, is the wife responsible for the debt? Does she have to divorce him in order to be protected from him putting her in debt? Also, someone told me that a spouse is legally responsible for all his/her partner's debt even two years after a divorce. Is that true?

Re: Abandonment and Debts

YOUR QUESTION # 1:

If a husband abandons his wife and children, moves to Las Vegas and gets a credit card, is the wife responsible for the debt?

ANSWER:

No. If husband obtains the credit card in his own name and without your co-signing the application form, you are not responsible for charges made on that account.

YOUR QUESTION # 2:

Does she have to divorce him in order to be protected from him putting her in debt?

ANSWER: No.

YOUR QUESTION # 2:

Also, someone told me that a spouse is legally responsible for all his/her partner's debt even two years after a divorce. Is that true?

ANSWER: No. A divorced spouse is responsibile for the other divorced spouse's debts only to the extent the divorce decree so specifies.
