Legal Question in Family Law in Oregon

Age to chose parent in Oregon

I currently have full custody of my 6 year old daughter and she visits her mother every other weekend. Her mother is telling her that she can pick who she wants to live with when she is 12. My x-wife has a history of drug use so I'm not too worried about losing custody but would like to know what the law is in Oregon regarding a childs right to chose who they live with.

YOUR QUESTION:

I currently have full custody of my 6 year old daughter and she visits her mother every other weekend. Her mother is telling her that she can pick who she wants to live with when she is 12. I would like to know what the law is in Oregon regarding a childs right to chose who they live with.

MY ANSWER:

Your ex-wife is wrong. Under Oregon law (unlike the laws of some other states), the child does NOT have the right to choose who she wants to live with. The child does not have the right to choose who she wants to live with until she attains age 18. Then she can choose where and with whom she wants to live.
