Legal Question in Family Law in Oregon
Does an ex automatically get half of a pension if they have been married 10 years, and if so, is it from the date of divorce or the date of separating?
1 Answer from Attorneys
No, an ex does not automatically get half of a pension if they have been married for 10 years. Each case is decided on its own particular and unique facts. Pension interests may be divided incident to divorce if the equities of the case are such as to justify such a division. But it is not automatic.
