Legal Question in Family Law in Oregon

bigomy

My former spouse claims we were never legally married, however I have a certified copy of our marriage certificate. I filed for divorce in California. The divorce was final in 2001. My former spouse says she was married to someone else in 1989 and is trying to have our son adopted by her present ''husband''. Can I file bigomy charges and have her arrested and thereby stop this attempt to adopt my son?

Re: bigomy

yes, you can and should have her arrested. that will not stop the adoption, you have to object in court for that.

Re: bigomy

Your parental rights are not dependent upon being married. You should object to her attempt to have her current husband adopt your son. To do this you must file an ojbection in court, and assert your parental rights. If you do not act in a timely manner you may lose your parental rights.
