Child custody or guardianship

How would I obtain temporary custody or guardianship of my grandaughter. Her mother is incarcerated and has gave me a letter stating she gave me temporary custody but certain goverment angencies won't accept it and say I need a court order . So the obvious question is how do I obtain a court order.

You need more than simply a letter. You need a Power of Attorney for Temporary Delegation of Parental Authority.

See ORS 109.056, which says:

"A parent * * *, by a properly executed power of attorney, may delegate to another person, for a period not exceeding six months, any of the powers of the parent * * * regarding care, custody or property of the minor child, except the power to consent to marriage or adoption."

Most attorneys will be able to assist you in preparing the Power of Attorney, usually for a modest fee ($100 or less).
