Child Custody

I have recently been divorced and the ex and I have joint custody. We have two children, 14 yrs & 12 yrs. Is there an age in Oregon that a child can decide on their own which parent they want to live with? Would this supercede the custody order??

ANSWER:

Yes and Yes.

1. The age at which a child can decide on their own is age 18 (when they cease being children in the eyes of the law and become, legally, adults).

2. Their decision at age 18 would supercede the custody order (because at age 18 the child is no longer in the custody of either parent).
