Re: child custody/child endangerment

You will need to file a modification of parenting time action with your county court. After he is served, a hearing will be set. At that time, you will be able to present "evidence" or proof that it is not safe for her to be with him. Remember you may "know" in your heart, but you will need to prove it is not safe. If you are afraid of doing this, there is a process for an emergency hearing where you can ask that parenting time be suspended until the hearing. An emergency order limiting his parenting time is only for very extreme circumstances. Good luck. Call the Oregon State Bar for a referral to an attorney in your area.
