Can my husband take our daughter and leave? I am in school and get uneployment. I lost my job back in Auguest. He is moving to a different town in a different county. he is moving to find a job with his friends. I can not live with out my daughter. Can he legaly take her from me. please help.

In the absence of a court order imposing restrictions or limitations on either parent's parental authority, or some type of court order that grants custody of the children to one parent and denies it to the other (such as might be rendered as part of a divorce proceeding), your husband is free to take the children and go wherever he wants to go. And you in turn are free to then go get the children wherever they may be and take them back.

In sum, the children are up for grabs. He can snatch the kids from you, and you can snatch them back. In the absence of a court order saying otherwise, neither parent has any greater right of custody than the other.
